{"data":{"id":"us-ut/utah-code-57-21-4","jurisdiction":"us-ut","citation":"Utah Code § 57-21-4","heading":"Conduct and requirements excluded -- Defenses.","body":"(1) Except as provided in Subsections 57-21-5(4) and (5), this chapter does not:\n(a) require a person to exercise a higher degree of care toward an individual who has a disability than toward an individual who does not have a disability;\n(b) relieve a person of an obligation generally imposed on all persons regardless of disability in a written lease, rental agreement, contract of purchase or sale, mortgage, trust deed, or other financing agreement; or\n(c) prohibit any program, service, facility, or privilege intended to habilitate, rehabilitate, or accommodate an individual with a disability.\n(2)\n(a) It is a defense to a complaint or action brought under this chapter that the complainant has a disability that, in the circumstances and even with reasonable accommodation, poses a serious threat to the health or safety of the complainant or others.\n(b) The respondent bears the burden of proving a defense in accordance with Subsection (2)(a).","path":["Title 57 Real Estate","Chapter 57-21 Utah Fair Housing Act"],"source_url":"https://le.utah.gov/xcode/Title57/Chapter21/57-21-S4.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"c3c95603c6509e3355d105146710d0f74157904bf35113ee4b2dd6cf92b2bc07","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-57-21-3","next":"us-ut/utah-code-57-21-5"},"notice":"GroundRules: Original legal text.
