{"data":{"id":"us-ut/utah-code-57-29-303","jurisdiction":"us-ut","citation":"Utah Code § 57-29-303","heading":"Investigatory powers and proceedings of division.","body":"(1) The division may:\n(a) conduct a public or private investigation to determine whether a person has violated or is about to violate a provision of this chapter; and\n(b) require or allow a person to file a written statement with the division that relates to the facts and circumstances concerning a matter to be investigated.\n(2) For the purpose of an investigation or proceeding under this chapter, the division may:\n(a) administer oaths or affirmations; and\n(b) upon the division's own initiative or upon the request of any party:\n(i) subpoena a witness;\n(ii) compel a witness's attendance;\n(iii) take evidence; or\n(iv) require the production, within 10 business days, of any information or item that is relevant to the investigation, including:\n(A) the existence, description, nature, custody, condition, and location of any books, electronic records, documents, or other tangible records;\n(B) the identity and location of any person who has knowledge of relevant facts; or\n(C) any other information or item that is reasonably calculated to lead to the discovery of material evidence.\n(3) If a person fails to obey a subpoena or other request made in accordance with this section, the division may petition a court with jurisdiction under Title 78A, Judiciary and Judicial Administration, for an order compelling compliance.","path":["Title 57 Real Estate","Chapter 57-29 Undivided Fractionalized Long-term Estate Sales Practices Act","Part 57-29-3 Investigation and Enforcement"],"source_url":"https://le.utah.gov/xcode/Title57/Chapter29/57-29-S303.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"b99756f046d0d900b77e7a19cf4f6f7cb9c60eb100b96f6fbfe9046fafa06f80","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-57-29-302","next":"us-ut/utah-code-57-29-304"},"notice":"GroundRules: Original legal text.
