{"data":{"id":"us-ut/utah-code-57-3-107","jurisdiction":"us-ut","citation":"Utah Code § 57-3-107","heading":"Unenforceable covenants -- Definition -- Inclusion in recorded document.","body":"(1) As used in this chapter, \"unenforceable covenant\" means a restriction on alienation of real property, whether recited in a document to be recorded under this chapter, or recited in a document of record under this chapter, which is based on race, gender, national origin, marital status, or a similar classification determined to be unenforceable under state or federal law.\n(2) A document which recites an unenforceable covenant may be recorded as provided in this chapter.\n(3) Any unenforceable covenant recited in a document to be recorded under this chapter or recited in a document of record is considered void, but does not invalidate the remainder of the document.","path":["Title 57 Real Estate","Chapter 57-3 Recording of Documents","Part 57-3-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title57/Chapter3/57-3-S107.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"c882150abc1b76eb8c82a9bf4c07d94d5a5b3b605ca3aa98beaa75ec36c394e1","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-57-3-106","next":"us-ut/utah-code-57-3-108"},"notice":"GroundRules: Original legal text.
