{"data":{"id":"us-ut/utah-code-57-8-7.2","jurisdiction":"us-ut","citation":"Utah Code § 57-8-7.2","heading":"Scope -- Designation of certain areas.","body":"(1) Unless otherwise provided in the declaration, this section applies to a unit if the declaration designates a wall, floor, or ceiling as a boundary of the unit.\n(2)\n(a) The following are part of a unit:\n(i) lath;\n(ii) furring;\n(iii) wallboard;\n(iv) plasterboard;\n(v) plaster;\n(vi) paneling;\n(vii) tiles;\n(viii) wallpaper;\n(ix) paint;\n(x) finished flooring; and\n(xi) any other material constituting part of the finished surface of a wall, floor, or ceiling.\n(b) Any portion of a wall, floor, or ceiling not listed in Subsection (2)(a) is part of the common areas and facilities.\n(3) If a chute, flue, duct, pipe, wire, conduit, bearing wall, bearing column, or any other fixture lies partially within and partially outside the designated boundaries of a unit:\n(a) any portion of an item described in this Subsection (3) serving only that unit is part of the limited common areas and facilities; and\n(b) any portion of an item described in this Subsection (3) is part of the common areas and facilities if the item serves:\n(i) more than one unit; or\n(ii) any portion of the common areas and facilities.\n(4) Subject to Subsection (3), the following within the boundaries of a unit are part of the unit:\n(a) spaces;\n(b) interior partitions; and\n(c) other fixtures and improvements.\n(5) The following, if designated to serve a single unit but located outside the unit's boundaries, are limited common areas and facilities allocated exclusively to a unit:\n(a) a shutter;\n(b) an awning;\n(c) a window box;\n(d) a doorstep;\n(e) a stoop;\n(f) a porch;\n(g) a balcony;\n(h) a patio;\n(i) an exterior door;\n(j) an exterior window; and\n(k) any other fixture.","path":["Title 57 Real Estate","Chapter 57-8 Condominium Ownership Act"],"source_url":"https://le.utah.gov/xcode/Title57/Chapter8/57-8-S7.2.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"f766a262cb7ebd4bf2333697fb0ad8efaae1288f8dfbe98bff47f3f31043e41b","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-57-8-7","next":"us-ut/utah-code-57-8-7.5"},"notice":"GroundRules: Original legal text.
