{"data":{"id":"us-ut/utah-code-58-1-112","jurisdiction":"us-ut","citation":"Utah Code § 58-1-112","heading":"Data collection.","body":"(1) As used in this section:\n(a) \"Council\" means the Utah Health Workforce Advisory Council created in Section 26B-1-425.\n(b) \"Information center\" means the Utah Health Workforce Information Center created in Section 26B-4-705.\n(2)\n(a) In accordance with Subsection 26B-4-705(3)(a), the department shall work with the information center to identify relevant data pertaining to a profession described in Subsection (3).\n(b) The data should focus on:\n(i) identifying workforce shortages;\n(ii) identifying labor market indicators;\n(iii) determining the educational background of a licensee; and\n(iv) determining whether Utah is retaining a stable health workforce.\n(c) After the council approves data to be collected, the department shall request the data from a licensee when a licensee applies for a license or renews the licensee's license.\n(d) The department shall send the obtained data to the information center.\n(e) A licensee may not be denied a license for failing to provide the data described in Subsection (2)(c) to the department.\n(3)\n(a) The department shall prioritize data collection for each profession licensed under:\n(i) Chapter 31b, Nurse Practice Act;\n(ii) Chapter 60, Mental Health Professional Practice Act;\n(iii) Chapter 61, Psychologist Licensing Act;\n(iv) Chapter 67, Utah Medical Practice Act;\n(v) Chapter 68, Utah Osteopathic Medical Practice Act;\n(vi) Chapter 69, Dentist and Dental Hygienist Practice Act; or\n(vii) Chapter 70a, Utah Physician Assistant Act.\n(b) After the department has collected data for each profession described in Subsection (3)(a), the department shall collect data for each profession licensed under:\n(i) Chapter 5a, Podiatric Physician Licensing Act;\n(ii) Chapter 17b, Pharmacy Practice Act;\n(iii) Chapter 24b, Physical Therapy Practice Act;\n(iv) Chapter 40, Recreational Therapy Practice Act;\n(v) Chapter 41, Speech-Language Pathology and Audiology Licensing Act;\n(vi) Chapter 42a, Occupational Therapy Practice Act;\n(vii) Chapter 44a, Nurse Midwife Practice Act;\n(viii) Chapter 54, Radiologic Technologist, Radiologist Assistant, and Radiology Practical Technician Licensing Act; or\n(ix) Chapter 57, Respiratory Care Practices Act.\n(c) The department shall collect data in accordance with this section for any health-related occupation or profession that is regulated by the department and is not described in Subsection (3)(a) or (b) if:\n(i) funding is available;\n(ii) the council has identified a need for the data; and\n(iii) data has been collected for each profession described in Subsections (3)(a) and (3)(b).","path":["Title 58 Occupations and Professions","Chapter 58-1 Division of Professional Licensing Act","Part 58-1-1 Division Administration"],"source_url":"https://le.utah.gov/xcode/Title58/Chapter1/58-1-S112.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"82ff7f3ee35f577fde573037dff86d8b694c092eb4754d7ef58cd2941b459893","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-58-1-111","next":"us-ut/utah-code-58-1-113"},"notice":"GroundRules: Original legal text.
