{"data":{"id":"us-ut/utah-code-58-17b-804","jurisdiction":"us-ut","citation":"Utah Code § 58-17b-804","heading":"Qualifications for licensure as a dispensing medical practitioner clinic pharmacy.","body":"(1) An applicant for a license as a dispensing medical practitioner clinic pharmacy shall comply with Section 58-17b-306.\n(2)\n(a) Notwithstanding Section 58-17b-302, a pharmacy licensed under this part is not required to have a pharmacist-in-charge if:\n(i) the pharmacy has designated a dispensing medical practitioner as responsible for all activities of the pharmacy; and\n(ii) the pharmacy complies with administrative rules adopted by the division in consultation with the Board of Pharmacy and the governing bodies of the practitioners described in Subsection 58-17b-102(23)(a).\n(b) Notwithstanding Subsection 58-17b-306(1)(e), the division, in consultation with the Board of Pharmacy and the governing boards of the practitioners described in Subsection 58-17b-102(23)(a), may modify the operating standards for a dispensing medical practitioner clinic pharmacy.","path":["Title 58 Occupations and Professions","Chapter 58-17b Pharmacy Practice Act","Part 58-17b-8 Dispensing Medical Practitioner and Dispensing Medical Practitioner Clinic Pharmacy"],"source_url":"https://le.utah.gov/xcode/Title58/Chapter17b/58-17b-S804.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"5c13dac3857183cfe6ead08221205d20fa612391e9c82cfd9d8cb4051b3bd297","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-58-17b-803","next":"us-ut/utah-code-58-17b-805"},"notice":"GroundRules: Original legal text.
