{"data":{"id":"us-ut/utah-code-58-17b-907","jurisdiction":"us-ut","citation":"Utah Code § 58-17b-907","heading":"Rules made by the division.","body":"The rules made by the division under Subsection 58-17b-903(2)(b) shall include:\n(1) registration requirements to establish the eligibility of a pharmacy to participate in the program;\n(2) a formulary that includes all eligible prescription drugs approved by the federal Food and Drug Administration;\n(3) standards and procedures for:\n(a) verifying whether a pharmacy or pharmacist participating in the program is licensed and in good standing with the board;\n(b) handling of an eligible prescription drug transferred in accordance with Subsection 58-17b-903(2) to an eligible pharmacy or a physician's office, including:\n(i) acceptance;\n(ii) identification, including redundant criteria for verification;\n(iii) documentation, under 21 U.S.C. Sec. 360eee-1, of transaction information, history, and statements;\n(iv) safe storage;\n(v) security;\n(vi) inspection;\n(vii) transfer; and\n(viii) dispensing;\n(c) a pharmacist, pharmacy intern, or licensed pharmacy technician:\n(i) working in or consulting with a participating eligible donor; or\n(ii) assisting an individual donating the eligible prescription drug;\n(d) disposition of a donated prescription drug that is a controlled substance;\n(e) record keeping regarding:\n(i) the individual or eligible donor that transferred an eligible prescription drug under Subsection 58-17b-903(2)(a);\n(ii) the identification and evaluation of a donated prescription drug by a pharmacist or licensed pharmacy technician; and\n(iii) the dispensing or disposition of a prescription drug;\n(f) determining the status of a medically indigent individual;\n(g) labeling requirements to:\n(i) ensure compliance with patient privacy laws relating to:\n(A) an individual who receives an eligible prescription drug; and\n(B) patient information that may appear on a donated prescription drug;\n(ii) clearly identify an eligible prescription drug dispensed under the program; and\n(iii) communicate necessary information regarding the manufacturer's recommended expiration date or the beyond use date; and\n(h) ensuring compliance with the requirements of this part;\n(4) a process for seeking input from the Department of Health and Human Services created in Section 26B-1-201 to:\n(a) establish program standards and procedures for assisted living facilities and nursing care facilities; and\n(b) establish program standards and procedures for mental health and substance abuse clients; and\n(5) the creation of a special training program that a pharmacist and a licensed pharmacy technician at an eligible pharmacy must complete before participating in the program.","path":["Title 58 Occupations and Professions","Chapter 58-17b Pharmacy Practice Act","Part 58-17b-9 Charitable Prescription Drug Recycling Act"],"source_url":"https://le.utah.gov/xcode/Title58/Chapter17b/58-17b-S907.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"4d87007946382d9fc2aa266d280e3bd9dab2e6ad9f101e4b12bda745e278eaa2","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-58-17b-906","next":"us-ut/utah-code-58-17b-1001"},"notice":"GroundRules: Original legal text.
