{"data":{"id":"us-ut/utah-code-58-31b-201","jurisdiction":"us-ut","citation":"Utah Code § 58-31b-201","heading":"Board.","body":"(1) There is created the Board of Nursing and Certified Nurse Midwives that consists of the following members:\n(a) five nurses in a manner as may be further defined in division rule;\n(b) two nurse midwives as defined in Section 58-44a-102; and\n(c) two members of the public.\n(2) The board shall be appointed and serve in accordance with Section 58-1-201.\n(3) The board shall:\n(a) carry out the duties and responsibilities described in Sections 58-1-202 and 58-1-203 with respect to this chapter and Chapter 44a, Nurse Midwife Practice Act; and\n(b) recommend to the division minimum standards for educational programs qualifying a person for licensure or certification under this chapter and Chapter 44a, Nurse Midwife Practice Act;\n(c) recommend to the division denial, approval, or withdrawal of approval regarding educational programs that meet or fail to meet the established minimum standards; and\n(d) designate one of its members on a permanent or rotating basis to:\n(i) assist the division in reviewing complaints concerning the conduct of an individual licensed under this chapter or Chapter 44a, Nurse Midwife Practice Act; and\n(ii) advise the division in its investigation of these complaints.\n(4) A board member who has, under Subsection (3)(d), reviewed a complaint or advised in its investigation may be disqualified from participating with the board when the board serves as a presiding officer in an adjudicative proceeding concerning the complaint.","path":["Title 58 Occupations and Professions","Chapter 58-31b Nurse Practice Act","Part 58-31b-2 Board"],"source_url":"https://le.utah.gov/xcode/Title58/Chapter31b/58-31b-S201.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"437ac49f7108f1e62a4ac5b08ec1db54b84497cbf5cdbe36095f03efe3916682","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-58-31b-103","next":"us-ut/utah-code-58-31b-301"},"notice":"GroundRules: Original legal text.
