{"data":{"id":"us-ut/utah-code-58-40-502","jurisdiction":"us-ut","citation":"Utah Code § 58-40-502","heading":"Unprofessional conduct.","body":"\"Unprofessional conduct\" includes:\n(1) failing to supervise a therapeutic recreation technician, a student intern, or a temporarily licensed therapeutic recreation specialist when required to do so under this chapter or by rule;\n(2) failing to keep or maintain a recreational therapy treatment plan;\n(3) failing to safeguard a person's right to privacy as to the person's identity, condition, diagnosis, personal effects, or other matters about which the licensee is privileged to know from providing recreational therapy services;\n(4) failing to report to the division the unsafe, unethical, or illegal practice of a person who is providing recreational therapy services;\n(5) making sexual advances to a patient, requesting sexual intercourse or sexual favors from a patient, or engaging in other verbal or physical conduct of a sexual nature in the presence of a patient;\n(6) exploiting a patient or former patient for personal gain;\n(7) possessing or dispensing illegal or non-prescribed prescription drugs or medications;\n(8) using or being under the influence of alcohol or an illegal or non-prescribed prescription drug or medication while performing recreational therapy services; and\n(9) other actions as defined by division rule.","path":["Title 58 Occupations and Professions","Chapter 58-40 Recreational Therapy Practice Act","Part 58-40-5 Unlawful and Unprofessional Conduct - Penalties"],"source_url":"https://le.utah.gov/xcode/Title58/Chapter40/58-40-S502.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"4bac0f193febebde03eb6b3991f5a21d72527c55f2ec61b282c6dc69177b28b3","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-58-40-501","next":"us-ut/utah-code-58-40-601"},"notice":"GroundRules: Original legal text.
