{"data":{"id":"us-ut/utah-code-58-76-103","jurisdiction":"us-ut","citation":"Utah Code § 58-76-103","heading":"Professional Geologist Education and Enforcement Account.","body":"(1) There is created a restricted account within the General Fund known as the \"Professional Geologist Education and Enforcement Account.\"\n(2) The restricted account shall consist of money from:\n(a) a surcharge fee established by the department in accordance with Section 63J-1-504, placed on initial, renewal, and reinstatement licensure fees under this chapter not to exceed 50% of the respective initial, renewal, or reinstatement licensure fee;\n(b) administrative penalties collected pursuant to this chapter; and\n(c) interest earned on money in the account.\n(3) Money in the account may be appropriated by the Legislature for the following purposes:\n(a) education and training of licensees under this chapter;\n(b) education and training of the public or other interested persons in matters concerning geology laws and practices;\n(c) enforcement of this chapter by:\n(i) investigating unprofessional or unlawful conduct;\n(ii) providing legal representation to the division when legal action is taken against a person engaging in unprofessional or unlawful conduct; and\n(iii) monitoring compliance of renewal requirements; and\n(d) education and training of board members.","path":["Title 58 Occupations and Professions","Chapter 58-76 Professional Geologist Licensing Act","Part 58-76-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title58/Chapter76/58-76-S103.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"fb0bf53188d1e1e19c0573c461fcb6ae862b22de605e8e745c3b21c5c53ba8ee","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-58-76-102","next":"us-ut/utah-code-58-76-201"},"notice":"GroundRules: Original legal text.
