{"data":{"id":"us-ut/utah-code-58-88-201","jurisdiction":"us-ut","citation":"Utah Code § 58-88-201","heading":"Definitions.","body":"As used in this part:\n(1)\n(a) \"Dispense\" means the delivery by a prescriber of a prescription drug or device to a patient, including the packaging, labeling, and security necessary to prepare and safeguard the drug or device for supplying to a patient.\n(b) \"Dispense\" does not include:\n(i) prescribing or administering a drug or device; or\n(ii) delivering to a patient a sample packaged for individual use by a licensed manufacturer or re-packager of a drug or device.\n(2) \"Dispensing practitioner\" means an individual who:\n(a) is currently licensed as:\n(i) a physician and surgeon under Chapter 67, Utah Medical Practice Act;\n(ii) an osteopathic physician and surgeon under Chapter 68, Utah Osteopathic Medical Practice Act;\n(iii) an advanced practice registered nurse under Subsections 58-31b-301(2)(a) through (b);\n(iv) a physician assistant under Chapter 70a, Utah Physician Assistant Act;\n(v) a dentist under Chapter 69, Dentist and Dental Hygienist Practice Act; or\n(vi) an optometrist under Chapter 16a, Utah Optometry Practice Act;\n(b) is authorized by state law to prescribe and administer drugs in the course of professional practice; and\n(c) practices at a licensed dispensing practice.\n(3) \"Drug\" means the same as that term is defined in Section 58-17b-102.\n(4) \"Health care practice\" means:\n(a) a health care facility as defined in Section 26B-2-201; or\n(b) the offices of one or more private prescribers, whether for individual or group practice.\n(5) \"Licensed dispensing practice\" means a health care practice that is licensed as a dispensing practice under Section 58-88-202.","path":["Title 58 Occupations and Professions","Chapter 58-88 General Health Professions","Part 58-88-2 Dispensing Practice"],"source_url":"https://le.utah.gov/xcode/Title58/Chapter88/58-88-S201.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"e645c56b963b53bd4f5b04ce4f6e5ddb4be59c408e35f3604886f53e3de796c9","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-58-87-502","next":"us-ut/utah-code-58-88-202"},"notice":"GroundRules: Original legal text.
