{"data":{"id":"us-ut/utah-code-58-9-502","jurisdiction":"us-ut","citation":"Utah Code § 58-9-502","heading":"Unprofessional conduct.","body":"(1) \"Unprofessional conduct\" includes:\n(a) the failure of a funeral service director to accurately document, report, and supervise the activities of a funeral service intern;\n(b) knowingly soliciting the sale of any funeral service or funeral merchandise for a person whose death occurred or was imminent prior to the solicitation;\n(c) paying or offering to pay a commission or anything of value to secure deceased human remains for a funeral service or disposition to:\n(i) medical personnel;\n(ii) a nursing home;\n(iii) a nursing home employee;\n(iv) a hospice;\n(v) a hospice employee;\n(vi) clergy;\n(vii) a government official; or\n(viii) any other third party; and\n(d) failure to provide the following current information to the division:\n(i) a licensee's business address;\n(ii) a licensee's primary residence;\n(iii) a funeral service establishment's funeral service director; or\n(iv) a supervising funeral service director's funeral service intern's name.\n(2) \"Unprofessional conduct\" does not include:\n(a) general advertising directed to the public at large; or\n(b) responding to a notification of death from:\n(i) medical personnel;\n(ii) a nursing home;\n(iii) a nursing home employee;\n(iv) a hospice;\n(v) a hospice employee;\n(vi) clergy;\n(vii) a government official; or\n(viii) any authorized representative of the family of the deceased person.","path":["Title 58 Occupations and Professions","Chapter 58-9 Funeral Services Licensing Act","Part 58-9-5 Unlawful and Unprofessional Conduct - Penalties"],"source_url":"https://le.utah.gov/xcode/Title58/Chapter9/58-9-S502.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"280e0c821d6adbb203083603799a5f0e3a04d874d77426d8ea3959fd79fa6631","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-58-9-501","next":"us-ut/utah-code-58-9-503"},"notice":"GroundRules: Original legal text.
