{"data":{"id":"us-ut/utah-code-58-9-601","jurisdiction":"us-ut","citation":"Utah Code § 58-9-601","heading":"Advance directions.","body":"(1) A person may provide written directions, acknowledged before a notary public or executed with the same formalities required of a will under Section 75-2-502, to direct the preparation, type, and place of the person's disposition, including:\n(a) designating a funeral service establishment;\n(b) providing directions for burial arrangements;\n(c) providing directions for cremation arrangements; or\n(d) providing directions for alkaline hydrolysis arrangements.\n(2) A funeral service director shall carry out the written directions of the decedent prepared under this section to the extent that:\n(a) the directions are lawful; and\n(b) the decedent has provided resources to carry out the directions.\n(3) Directions for disposition contained in a will shall be carried out pursuant to Subsection (2) regardless of:\n(a) the validity of other aspects of the will; or\n(b) the fact that the will may not be offered or admitted to probate until a later date.\n(4) A person may change or cancel written directions prepared under this section at any time prior to the person's death by providing written notice to all applicable persons, including:\n(a) if the written directions designate a funeral service establishment or funeral service director, the funeral service establishment or funeral service director designated in the written directions; and\n(b) if the written directions are contained in a will, the personal representative as defined in Section 75-1-201.","path":["Title 58 Occupations and Professions","Chapter 58-9 Funeral Services Licensing Act","Part 58-9-6 Control of Disposition"],"source_url":"https://le.utah.gov/xcode/Title58/Chapter9/58-9-S601.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"a7fe8873ee3bf16e95277da411e31a602eb55f64fff99241b2d106c1985d238f","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-58-9-506","next":"us-ut/utah-code-58-9-602"},"notice":"GroundRules: Original legal text.
