{"data":{"id":"us-ut/utah-code-58-91-301","jurisdiction":"us-ut","citation":"Utah Code § 58-91-301","heading":"Scope of practice of a constable -- License required on or after January 1, 2027.","body":"(1) A constable may:\n(a) serve legal documents throughout the state;\n(b) serve any civil process throughout the state, including orders of restitution and writs of execution;\n(c) when acting under the direction of a contracting governmental entity, arrest an individual pursuant to an arrest warrant in any location in the state;\n(d) when acting under the direction of a contracting governmental entity, transport a prisoner within the state; and\n(e) when acting under the direction of a justice court, take an action described in Subsection 17-78-603(2).\n(2) A constable who is acting under the direction of a contracting governmental entity shall provide the division with a copy of the constable's contract with the contracting governmental entity.\n(3) A constable:\n(a) may take any action within the constable's scope of practice; and\n(b) when acting under the direction of a contracting governmental entity, shall take action in accordance with the contracting governmental entity's direction and pursuant to the contract between the constable and the contracting governmental entity.\n(4) Upon termination of a contract between a constable and a contracting governmental entity, the constable shall notify the division no later than five business days after the day on which the termination takes effect.\n(5) Beginning January 1, 2027, a license is required to engage in the practice of a constable, whether the constable engages a client, a contracting governmental entity, or both, except as provided in Sections 58-1-307 and 58-91-304.","path":["Title 58 Occupations and Professions","Chapter 58-91 Constables Licensing Act","Part 58-91-3 Licensing Constables"],"source_url":"https://le.utah.gov/xcode/Title58/Chapter91/58-91-S301.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"af29fb74f5efbe3981120a9c06ab8ad63be8467fb2eb9a07a764de187fc3080d","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-58-91-201","next":"us-ut/utah-code-58-91-302"},"notice":"GroundRules: Original legal text.
