{"data":{"id":"us-ut/utah-code-58-91-304","jurisdiction":"us-ut","citation":"Utah Code § 58-91-304","heading":"Exemptions from licensure.","body":"(1) In addition to the exemptions from licensure in Section 58-1-307, an individual may engage in acts regulated under this chapter without being licensed under this chapter if the individual is:\n(a) a peace officer employed by a constable as provided in Subsection (2);\n(b) licensed by the division under another chapter of this title to engage in the act; or\n(c) a peace officer acting in the scope of the peace officer's employment.\n(2) A peace officer may only engage in off-duty employment with a constable if:\n(a) the law enforcement agency employing the peace officer has a written policy regarding peace officer employees working while off duty as a constable and the written policy addresses the issue of financial responsibility;\n(b) the law enforcement agency's chief administrative officer, or that officer's designee, provides written authorization for an off-duty peace officer to work as a constable; and\n(c) the client, contracting governmental entity, or licensed constable employing the peace officer to work as a constable complies with state and federal income reporting and withholding requirements regarding the off-duty peace officer's wages.","path":["Title 58 Occupations and Professions","Chapter 58-91 Constables Licensing Act","Part 58-91-3 Licensing Constables"],"source_url":"https://le.utah.gov/xcode/Title58/Chapter91/58-91-S304.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"927543e9d7c71721ad30e152e2cef73c3d091baa2cec9b6f370872ff6bd222c0","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-58-91-303","next":"us-ut/utah-code-58-91-305"},"notice":"GroundRules: Original legal text.
