{"data":{"id":"us-ut/utah-code-61-1-102","jurisdiction":"us-ut","citation":"Utah Code § 61-1-102","heading":"Definitions.","body":"As used in this part:\n(1) \"Adverse action\" means to:\n(a) discharge, threaten, or directly or indirectly harass an employee; or\n(b) otherwise discriminate against an employee in any manner that affects the employee's employment, including:\n(i) compensation;\n(ii) terms;\n(iii) conditions;\n(iv) location;\n(v) rights;\n(vi) immunities;\n(vii) promotions; or\n(viii) privileges.\n(2) \"Covered judicial or administrative action\" means a judicial or administrative action brought under this chapter that results in a monetary sanction exceeding $50,000.\n(3) \"Employee\" means an individual who performs a service for wages or other remuneration under a contract of hire, written or oral, express or implied.\n(4) \"Fund\" means the Securities Investor Education, Training, and Enforcement Fund created in Section 61-1-18.7.\n(5) \"Original information\" means information that is:\n(a) derived from the independent knowledge or analysis of an individual;\n(b) not known to the division or commission from a source other than the individual; and\n(c) unless the individual is the source of the information, not exclusively derived from:\n(i) an allegation made in a judicial or administrative hearing;\n(ii) a government report, hearing, audit, or investigation; or\n(iii) the media.\n(6) \"Monetary sanction\" means money required to be paid under this chapter as the result of a judicial or administrative action, including a penalty or disgorgement.\n(7) \"Reporter\" means an individual who provides original information relating to a violation in accordance with Section 61-1-103.","path":["Title 61 Securities Division - Real Estate Division","Chapter 61-1 Utah Uniform Securities Act","Part 61-1-1 Securities Fraud Reporting Program Act"],"source_url":"https://le.utah.gov/xcode/Title61/Chapter1/61-1-S102.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"5f5faebba44d96e7cddde5860390bb0b5a95bfdc9b40127496231a8d73653143","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-61-1-101","next":"us-ut/utah-code-61-1-103"},"notice":"GroundRules: Original legal text.
