{"data":{"id":"us-ut/utah-code-61-2c-203","jurisdiction":"us-ut","citation":"Utah Code § 61-2c-203","heading":"General qualifications for licensure.","body":"(1) To qualify for licensure under this chapter, a person shall demonstrate through procedures established by rule made by the division in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act:\n(a) financial responsibility;\n(b) honesty, integrity, and truthfulness; and\n(c) the competence to transact the business of residential mortgage loans, including general fitness such as to command the confidence of the community and to warrant a determination that the person will operate honestly, fairly, and efficiently within the purposes of this chapter.\n(2) If an applicant is an entity, the applicant may not have a control person who fails to meet the requirements of Subsection (1) for an individual applicant.\n(3)\n(a) The division shall determine whether an applicant with a criminal history qualifies for licensure.\n(b) If the division, acting under Subsection (3)(a), denies or restricts a license or places a license on probation, the applicant may petition the commission for de novo review of the application.","path":["Title 61 Securities Division - Real Estate Division","Chapter 61-2c Utah Residential Mortgage Practices and Licensing Act","Part 61-2c-2 Licensure"],"source_url":"https://le.utah.gov/xcode/Title61/Chapter2c/61-2c-S203.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"04491700a6cd44c0a44acad5b35282c4d9c594e1d63c8f45cda482cea88a8eac","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-61-2c-202","next":"us-ut/utah-code-61-2c-204.1"},"notice":"GroundRules: Original legal text.
