{"data":{"id":"us-ut/utah-code-63a-14-102","jurisdiction":"us-ut","citation":"Utah Code § 63A-14-102","heading":"Definitions.","body":"As used in this chapter:\n(1) \"Commission\" means the Independent Executive Branch Ethics Commission, created in Section 63A-14-202.\n(2) \"Complainant\" means an individual who files a complaint under Subsection 63A-14-402(1)(a).\n(3) \"Executive branch elected official\" means:\n(a) the governor;\n(b) the lieutenant governor;\n(c) the state auditor;\n(d) the state treasurer; or\n(e) the attorney general.\n(4) \"Improper purpose\" includes harassing a respondent, causing unwarranted harm to a respondent's reputation, or causing unnecessary expenditure of public funds.\n(5) \"Malfeasance in office\" means an intentional act or omission relating to the duties of an executive branch elected official that:\n(a) constitutes a crime; or\n(b)\n(i) constitutes a substantial breach of the trust imposed upon the executive branch elected official by the nature of the official's office; and\n(ii) is against commonly accepted standards of honesty and morality.\n(6) \"Respondent\" means the executive branch elected official against whom an ethics complaint described in Section 63A-14-402 is filed.\n(7) \"Violation\" means a high crime, a misdemeanor, or malfeasance in office.","path":["Title 63A Utah Government Operations Code","Chapter 63A-14 Review of Executive Branch Ethics Complaints","Part 63A-14-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter14/63A-14-S102.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"f4a0bda46fcb892490ec077d70d248342df12b0804f66a488c0c81b8758eb369","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-14-101","next":"us-ut/utah-code-63a-14-201"},"notice":"GroundRules: Original legal text.
