{"data":{"id":"us-ut/utah-code-63a-15-403","jurisdiction":"us-ut","citation":"Utah Code § 63A-15-403","heading":"Subpoena powers.","body":"(1) Except for a preliminary review described in Section 63A-15-602, for a proceeding authorized by this chapter, the commission may issue a subpoena to:\n(a) require the attendance of a witness;\n(b) direct the production of evidence; or\n(c) require both the attendance of a witness and the production of evidence.\n(2) The commission shall issue a subpoena:\n(a) in accordance with Section 63A-15-405;\n(b) at the direction of the commission chair, if the chair determines that the testimony or evidence is relevant to the review of a complaint under Part 7, Commission Review of Ethics Violation; or\n(c) upon a vote of a majority of the commission members.\n(3) If the commission issues a subpoena authorized under this section, the commission shall give a reasonable period of time for the person or entity to whom the subpoena is directed to petition a district court to quash or modify the subpoena before the time specified in the subpoena for compliance.","path":["Title 63A Utah Government Operations Code","Chapter 63A-15 Political Subdivisions Ethics Review Commission","Part 63A-15-4 Hearing on Ethics Complaint"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter15/63A-15-S403.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"1ca905f175756dec9ba0ddd012cd85af415c1c97ecc4bd7efb6d633d4aaa4fab","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-15-402","next":"us-ut/utah-code-63a-15-404"},"notice":"GroundRules: Original legal text.
