{"data":{"id":"us-ut/utah-code-63a-15-408","jurisdiction":"us-ut","citation":"Utah Code § 63A-15-408","heading":"Attorney fees and costs.","body":"(1) A person filing a complaint under this chapter:\n(a) may, but is not required to, retain legal representation during the complaint review process; and\n(b) is responsible for payment of complainant's attorney fees and costs incurred.\n(2)\n(a) A respondent against whom a complaint is filed under this chapter:\n(i) may, but is not required to, retain legal representation during the complaint review process;\n(ii) except as provided in Subsection (2)(a)(iii), is responsible for payment of the respondent's attorney fees and costs incurred; and\n(iii) may be entitled to the provision of legal defense by the political subdivision in accordance with Section 63G-7-902.\n(b) For purposes of Subsection (2)(a)(iii), a complaint filed against a respondent in accordance with this chapter shall constitute an action against a governmental employee in accordance with Section 63G-7-902.\n(3)\n(a) An attorney participating in a hearing before the commission shall comply with:\n(i) the Rules of Professional Conduct established by the Utah Supreme Court;\n(ii) the procedures and requirements of this chapter; and\n(iii) the directions of the chair and commission.\n(b) A violation of Subsection (3)(a) may constitute:\n(i) contempt of the commission under Section 63A-15-404; or\n(ii) a violation of the Rules of Professional Conduct subject to enforcement by the Utah State Bar.","path":["Title 63A Utah Government Operations Code","Chapter 63A-15 Political Subdivisions Ethics Review Commission","Part 63A-15-4 Hearing on Ethics Complaint"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter15/63A-15-S408.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"34f2d251381971bd1b6030e672dd25f5a5af32dcb56d043f5c0c1c6b0af7b7a2","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-15-407","next":"us-ut/utah-code-63a-15-501"},"notice":"GroundRules: Original legal text.
