{"data":{"id":"us-ut/utah-code-63a-15-705","jurisdiction":"us-ut","citation":"Utah Code § 63A-15-705","heading":"Criminal allegation -- Recommendation to county or district attorney or attorney general.","body":"(1) If the commission finds that a political subdivision officer or employee allegedly violated a criminal provision, the commission shall, in addition to sending a recommendation to a political subdivision governing body in accordance with Section 63A-15-704, send a written recommendation for further investigation to one or more of the following:\n(a) the county or district attorney of the applicable jurisdiction; or\n(b) the attorney general.\n(2) The written recommendation described in Subsection (1) shall:\n(a) list the name of each complainant;\n(b) list the name of the respondent;\n(c) state the date of the recommendation;\n(d) for each allegation of a criminal violation, provide a reference to the criminal provision allegedly violated;\n(e) include a general statement that is adopted by a majority of the members of the commission; and\n(f) state the name of the political subdivision governing body that the commission sent a recommendation to in accordance with Section 63A-15-704.\n(3) If the commission sends a recommendation in accordance with this section, the commission shall enter into the record:\n(a) a copy of the recommendation; and\n(b) the name of each person described in Subsection (1) to whom the commission sent the recommendation.\n(4) A recommendation prepared and delivered in accordance with this section is a public record.","path":["Title 63A Utah Government Operations Code","Chapter 63A-15 Political Subdivisions Ethics Review Commission","Part 63A-15-7 Commission Review of Ethics Violation"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter15/63A-15-S705.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"ceafe0a16f84462f76b0616a25588dde7c199c30c39eda70fd583be4fd23b376","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-15-704","next":"us-ut/utah-code-63a-15-706"},"notice":"GroundRules: Original legal text.
