{"data":{"id":"us-ut/utah-code-63a-19-102","jurisdiction":"us-ut","citation":"Utah Code § 63A-19-102","heading":"State data privacy policy.","body":"It is the policy of Utah that:\n(1) an individual has a fundamental interest in and inherent expectation of privacy regarding the individual's personal data that the individual provides to a governmental entity;\n(2) a governmental entity shall process personal data in a manner that is consistent with the interests and expectations described in Subsection (1);\n(3) the state shall encourage innovation to enhance the ability of a governmental entity to:\n(a) protect the privacy of an individual's personal data;\n(b) provide clear notice to an individual regarding the governmental entity's processing of the individual's personal data;\n(c) process personal data only for specified, lawful purposes and only process the minimum amount of an individual's personal data necessary to achieve those purposes;\n(d) implement appropriate consent mechanisms regarding the uses of an individual's personal data;\n(e) provide an individual with the ability to access, control, and request corrections to the individual's personal data held by a governmental entity;\n(f) maintain appropriate safeguards to protect the confidentiality, integrity, and availability of personal data;\n(g) account for compliance with privacy related laws, rules, and regulations that are specific to a particular governmental entity, program, or personal data; and\n(h) meet a governmental entity's and an individual's business and service needs;\n(4) the state shall promote training and education programs for employees of governmental entities focused on:\n(a) data privacy best practices, obligations, and responsibilities; and\n(b) the overlapping relationship with privacy, records management, and security; and\n(5) the state shall promote consistent terminology in data privacy requirements across governmental entities.","path":["Title 63A Utah Government Operations Code","Chapter 63A-19 Government Data Privacy Act","Part 63A-19-1 General Provisions -- State Data Privacy Policy"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter19/63A-19-S102.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"d77a0b40ec7bc07d00017f3a439b91bbde014cda784618f6992d14bf431e18db","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-19-101","next":"us-ut/utah-code-63a-19-201"},"notice":"GroundRules: Original legal text.
