{"data":{"id":"us-ut/utah-code-63a-19-203","jurisdiction":"us-ut","citation":"Utah Code § 63A-19-203","heading":"Utah Privacy Commission created.","body":"(1) There is created the Utah Privacy Commission.\n(2)\n(a) The commission shall be composed of no more than 14 members.\n(b) The governor shall appoint:\n(i) one member who, at the time of appointment provides internet technology services for a county;\n(ii) one member with experience in cybersecurity;\n(iii) one member representing private industry in technology;\n(iv) one member representing law enforcement;\n(v) one member with experience in data privacy law; and\n(vi) one member who is a private citizen representing the public.\n(c) The State Board of Education shall appoint one member representing public education entities and the privacy interests of students.\n(d) The state auditor shall appoint:\n(i) one member with experience in internet technology services;\n(ii) one member with experience in cybersecurity;\n(iii) one member representing private industry in technology;\n(iv) one member with experience in data privacy law; and\n(v) one member representing municipalities.\n(e) The attorney general shall appoint:\n(i) one member with experience as a prosecutor or appellate attorney and with experience in data privacy or civil liberties law; and\n(ii) one member representing law enforcement.\n(3)\n(a) Except as provided in Subsection (3)(b), a member is appointed for a term of four years.\n(b) The initial appointments of members described in Subsections (2)(b)(i) through (iii), (2)(d)(iv) and (v), and (2)(e)(ii) shall be for two-year terms.\n(c) When the term of a current member expires, a member shall be reappointed or a new member shall be appointed in accordance with Subsection (2).\n(4)\n(a) When a vacancy occurs in the membership for any reason, a replacement shall be appointed in accordance with Subsection (2) for the unexpired term.\n(b) A member whose term has expired may continue to serve until a replacement is appointed.\n(5) The commission shall select officers from the commission's members as the commission finds necessary.\n(6)\n(a) A majority of the members of the commission is a quorum.\n(b) The action of a majority of a quorum constitutes an action of the commission.\n(7) A member may not receive compensation or benefits for the member's service but may receive per diem and travel expenses incurred as a member of the commission at the rates established by the Division of Finance under:\n(a) Sections 63A-3-106 and 63A-3-107; and\n(b) rules made by the Division of Finance in accordance with Sections 63A-3-106 and 63A-3-107.\n(8) A member shall refrain from participating in a review of:\n(a) an entity of which the member is an employee; or\n(b) a technology in which the member has a financial interest.\n(9) The office shall provide staff and support to the commission.\n(10) The commission shall meet up to 12 times a year to accomplish the duties described in Section 63A-19-204.\n(11)\n(a) The commission shall, in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, make rules establishing participation requirements for commission members.\n(b) A commission member who fails to meet the participation requirements established under Subsection (11)(a) may be removed by the official who appointed the member in accordance with Subsection (2).","path":["Title 63A Utah Government Operations Code","Chapter 63A-19 Government Data Privacy Act","Part 63A-19-2 Utah Privacy Governing Board And Utah Privacy Commission"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter19/63A-19-S203.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"6cd4274a6482d937016a22b1ffd0ddc88ca2ec85fb603f4cdcd66e0a3294b250","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-19-202","next":"us-ut/utah-code-63a-19-204"},"notice":"GroundRules: Original legal text.
