{"data":{"id":"us-ut/utah-code-63a-19-402.5","jurisdiction":"us-ut","citation":"Utah Code § 63A-19-402.5","heading":"Website privacy notice.","body":"(1) A governmental entity's government website shall include notice to a user of:\n(a) the identity of the governmental entity responsible for the government website;\n(b) how to contact the governmental entity that is responsible for the government website;\n(c) the method by which a user may:\n(i) seek access to the user's personal data or user data;\n(ii) request to correct or amend the user's personal data or user data; and\n(iii) file a complaint with the data privacy ombudsperson; and\n(d) how an at-risk employee may request that the at-risk employee's personal information be classified as a private record under Section 63G-2-302.\n(2) In addition to the website privacy notice requirement described in Subsection (1)(a), a government website that collects user data shall include in the website privacy notice the following information:\n(a) any website tracking technology that is used to collect user data on the government website;\n(b) what user data is collected by the government website;\n(c) all intended purposes and uses of the user data;\n(d) the classes of persons and governmental entities:\n(i) with whom the governmental entity shares user data; or\n(ii) to whom the governmental entity sells user data; and\n(e) the record series in which the user data is included.\n(3) A notice described in Subsection (1) or (2) shall be provided by prominently posting on the homepage of the government website:\n(a) the notice; or\n(b) a link to a separate webpage containing the notice.\n(4) A governmental entity may not collect user data on a government website unless the governmental entity has complied with the requirements in this section.","path":["Title 63A Utah Government Operations Code","Chapter 63A-19 Government Data Privacy Act","Part 63A-19-4 Duties of Governmental Entities"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter19/63A-19-S402.5.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"11718849b3860565f783414844903c427fa8b46f919dc42248e314198abc8748","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-19-402","next":"us-ut/utah-code-63a-19-403"},"notice":"GroundRules: Original legal text.
