{"data":{"id":"us-ut/utah-code-63a-19-601","jurisdiction":"us-ut","citation":"Utah Code § 63A-19-601","heading":"Enforcement.","body":"(1) Upon instruction by the board, the state auditor shall:\n(a) investigate alleged violations of this chapter by a governmental entity;\n(b) provide notice to the relevant governmental entity of an alleged violation of this chapter; and\n(c) for a violation that the state auditor substantiates, provide an opportunity for the governmental entity to cure the violation within 30 days.\n(2) If a governmental entity fails to cure a violation as provided in Subsection (1)(c), the state auditor shall report the governmental entity's failure:\n(a) for a governmental entity that is not a state agency, to the attorney general for enforcement under Subsection (3); and\n(b) for a state agency, to the Legislative Management Committee.\n(3) After referral by the state auditor under Subsection (2)(a), the attorney general may file an action in district court to:\n(a) enjoin a governmental entity that is not a state agency from violating this chapter; or\n(b) require a governmental entity that is not a state agency to comply with this chapter.","path":["Title 63A Utah Government Operations Code","Chapter 63A-19 Government Data Privacy Act","Part 63A-19-6 Remedies"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter19/63A-19-S601.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"6e17bd6c63eac25b5ee1d83aad3c885012fd3e01ec886ba20f16595746915f47","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-19-502","next":"us-ut/utah-code-63a-19-602"},"notice":"GroundRules: Original legal text.
