{"data":{"id":"us-ut/utah-code-63a-2-103","jurisdiction":"us-ut","citation":"Utah Code § 63A-2-103","heading":"Duties and authority of purchasing director -- State agency requirements -- Rate schedule.","body":"(1) The purchasing director:\n(a) shall operate, manage, and maintain:\n(i) a central mailing service; and\n(ii) an electronic central store system for procuring goods and services;\n(b) shall operate, manage, and maintain the surplus property program; and\n(c) may establish:\n(i) a contract administration service, including contract performance surveys; and\n(ii) other central services.\n(2)\n(a) Each state agency shall:\n(i) subscribe to all of the services described in Subsection (1)(a), unless the director delegates the director's authority to a state agency under Section 63A-2-104; and\n(ii) complete contract performance surveys as requested by the purchasing director under Subsection (1)(c)(i).\n(b) An institution of higher education, the State Board of Education, a school district, or a political subdivision of the state may subscribe to one or more of the services described in Subsection (1)(a).\n(3)\n(a) The purchasing director shall:\n(i) prescribe a schedule of rates to be charged for all services provided by the division after the purchasing director:\n(A) submits the proposed rates for services provided by the division's internal service fund to the Rate Committee established in Section 63A-1-114; and\n(B) obtains the approval of the Legislature, as required by Section 63J-1-410;\n(ii) ensure that the rates are approximately equal to the cost of providing the services; and\n(iii) annually conduct a market analysis of rates.\n(b) A market analysis under Subsection (3)(a)(iii) shall include a comparison of the division's rates with the rates of other public or private sector providers if comparable services and rates are reasonably available.","path":["Title 63A Utah Government Operations Code","Chapter 63A-2 Division of Purchasing and General Services","Part 63A-2-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter2/63A-2-S103.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"74b79101bf84d8a5ad2d54e39da49dc8dfb818f5752ed827f463c59eba7ec0cf","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-2-102","next":"us-ut/utah-code-63a-2-104"},"notice":"GroundRules: Original legal text.
