{"data":{"id":"us-ut/utah-code-63a-20-801","jurisdiction":"us-ut","citation":"Utah Code § 63A-20-801","heading":"Complaints and enforcement.","body":"(1) An individual may submit a complaint to the data privacy ombudsperson alleging a violation of this chapter by:\n(a) the department;\n(b) a digital wallet provider;\n(c) a verifier; or\n(d) a relying party.\n(2) The data privacy ombudsperson may receive and review a complaint described in Subsection (1).\n(3) If, after reviewing a complaint, the data privacy ombudsperson has reasonable cause to believe that a violation of this chapter has occurred, the data privacy ombudsperson may refer the complaint to the attorney general.\n(4) Upon receiving a referral under Subsection (3), or when the attorney general has reasonable cause to believe that a violation of this chapter has occurred, the attorney general is authorized to:\n(a) issue civil investigative demands for depositions, documents, and requests for information in the time and manner prescribed by the attorney general; and\n(b) bring a civil action in a court of competent jurisdiction to:\n(i) enjoin a violation of this chapter;\n(ii) obtain declaratory relief regarding compliance with this chapter; or\n(iii) recover damages, restitution, and disgorgement on behalf of an individual injured by a violation of this chapter.\n(5) The attorney general shall treat all information received in accordance with Subsection (4) as non-public and confidential unless confidentiality is waived by the providing party, or upon the filing of an enforcement action.\n(6) In an action brought under Subsection (4), the court may award:\n(a) injunctive relief;\n(b) declaratory relief;\n(c) equitable relief including restitution and disgorgement;\n(d) actual damages;\n(e) costs; and\n(f) reasonable attorney fees.","path":["Title 63A Utah Government Operations Code","Chapter 63A-20 State-Endorsed Digital Identity","Part 63A-20-8 Enforcement And Audit"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter20/63A-20-S801.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"08869ecf1d547aaf89c4555319c6f877784352a14b77439190862804781f8670","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-20-702","next":"us-ut/utah-code-63a-20-802"},"notice":"GroundRules: Original legal text.
