{"data":{"id":"us-ut/utah-code-63a-5b-1101","jurisdiction":"us-ut","citation":"Utah Code § 63A-5b-1101","heading":"Gifts, grants, and donations.","body":"(1)\n(a) The state or the division may receive a gift, grant, or donation to further the purposes of this part.\n(b) A gift, grant, or donation described in Subsection (1)(a) may not revert to the General Fund.\n(2)\n(a) This Subsection (2) applies if:\n(i) a donor donates land to an institution of higher education and commits to construct a building or buildings on the land; and\n(ii) the institution of higher education:\n(A) agrees to provide funds for the operation and maintenance costs of the building or buildings from sources other than state funds; and\n(B) agrees that the building or buildings will not be eligible for state capital improvement funding.\n(b) Notwithstanding any other provision of this chapter, an institution of higher education that receives a donation described in Subsection (2)(a) may:\n(i) oversee and manage a construction project on the donated land without involvement, oversight, or management from the division; or\n(ii) arrange for oversight and management of the construction project by the division.\n(c) The role of compliance agency on a construction project on the donated land shall be provided by:\n(i) the institution of higher education, for a construction project that the institution of higher education oversees and manages under Subsection (2)(b); or\n(ii) the director, for a construction project that the division oversees and manages under Subsection (2)(b)(ii).","path":["Title 63A Utah Government Operations Code","Chapter 63A-5b Administration of State Facilities","Part 63A-5b-11 Miscellaneous Provisions"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter5b/63A-5b-S1101.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"97c7b212e7746a145adcbc6ae5adfe0275dd8c36a6a4aa7d61a93de4c278f531","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-5b-1004","next":"us-ut/utah-code-63a-5b-1102"},"notice":"GroundRules: Original legal text.
