{"data":{"id":"us-ut/utah-code-63a-5b-1209","jurisdiction":"us-ut","citation":"Utah Code § 63A-5b-1209","heading":"Historical project documentation and information requests.","body":"(1) Upon written request from the division, an LEA shall provide:\n(a) in accordance with Subsection (7), documentation and information regarding construction projects;\n(b) cost data, construction documents, and project records;\n(c) contractor and vendor information and performance records;\n(d) change order documentation and justifications;\n(e) inspection records and certificates of occupancy;\n(f) as-built drawings and project closeout documentation;\n(g) warranty information and maintenance records; and\n(h) any other project-related information the division determines necessary for:\n(i) establishing cost benchmarks and databases;\n(ii) analyzing construction cost trends;\n(iii) developing standardized design templates;\n(iv) creating training programs and best practices; or\n(v) other purposes related to public school construction oversight.\n(2) An LEA shall provide requested information:\n(a) within 90 days of receiving the division's written request;\n(b) in the format specified by the division;\n(c) organized and indexed for efficient review;\n(d) with complete documentation for each requested project; and\n(e) at no cost to the division.\n(3) If an LEA is unable to provide requested information within 30 days due to volume or complexity, the LEA shall:\n(a) notify the division within 10 days of receiving the request;\n(b) provide a detailed explanation of the delay;\n(c) propose a reasonable timeline for providing the information; and\n(d) provide interim updates on progress.\n(4) The division may use the information collected under this section to:\n(a) populate the construction cost database described in Section 63A-5b-1210;\n(b) establish baseline cost benchmarks;\n(c) identify best practices and areas for improvement;\n(d) develop training materials and resources;\n(e) create standardized design templates;\n(f) conduct research on construction cost drivers; and\n(g) provide better technical assistance to an LEA.\n(5) The division shall:\n(a) maintain the confidentiality of proprietary information submitted by an LEA;\n(b) use submitted information only for the purposes described in this section;\n(c) aggregate data when publishing reports or benchmarks to protect LEA-specific information where appropriate; and\n(d) provide an LEA with access to aggregated data and analysis.\n(6) Failure of an LEA to provide requested information without good cause may result in:\n(a) loss of certain oversight autonomy, including requirement for division-managed construction services under Section 63A-5b-1213; or\n(b) administrative penalties not exceeding $5,000, subject to appeal under Section 63A-5b-1221.\n(7) This section applies to:\n(a) all LEAs;\n(b) projects in process or completed after May 6, 2026; and\n(c) both new construction and major renovation projects.","path":["Title 63A Utah Government Operations Code","Chapter 63A-5b Administration of State Facilities","Part 63A-5b-12 Public School Construction Oversight"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter5b/63A-5b-S1209.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"bd8cf8c171143ef483c97d552998ba21e6689777e85e291eeac5275be5cf0194","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-5b-1208","next":"us-ut/utah-code-63a-5b-1210"},"notice":"GroundRules: Original legal text.
