{"data":{"id":"us-ut/utah-code-63a-5b-1214","jurisdiction":"us-ut","citation":"Utah Code § 63A-5b-1214","heading":"Construction oversight fee.","body":"(1) Except for an LEA that has hired a division approved project manager to provide services as described in this section, for all public school construction projects, an LEA shall pay the division a construction oversight, building official, plan review, and administration fee in accordance with a fee schedule established by division rule under Section 63A-5b-1217 and approved by the rate committee created in Section 63A-1-114.\n(2) The construction oversight fee:\n(a) applies to all projects subject to this part, regardless of whether the division is providing direct construction management services;\n(b) shall be established by division rule under Section 63A-5b-1217 to recover the reasonable costs of oversight activities and may be reduced or waived for LEAs with delegated oversight authority; and\n(c) may be included in the LEA's bond authorization or other funding mechanism.\n(3) The construction oversight fee assessed to an LEA shall fund the division's activities, including:\n(a) plan review and permitting;\n(b) inspection roster maintenance and oversight;\n(c) cost database development and maintenance;\n(d) training and technical assistance programs;\n(e) compliance monitoring and enforcement;\n(f) online document management system operation;\n(g) standardized design template development; and\n(h) other oversight activities required by this part.\n(4) For projects where the division provides direct construction management services under Section 63A-5b-1213:\n(a) the LEA shall not pay duplicative fees; and\n(b) the division shall clearly delineate the fee structure for oversight activities.\n(5) The division shall:\n(a) deposit all construction oversight fees into the restricted account established in Section 63A-5b-1219;\n(b) use fee revenue exclusively for public school construction oversight activities;\n(c) report annually to the Legislature on fee revenue and expenditures; and\n(d) adjust the fee rate only through legislative action.\n(6) An LEA may appeal fee assessments or payment schedule requirements under this section to the appeals panel established under Section 63A-5b-1221.","path":["Title 63A Utah Government Operations Code","Chapter 63A-5b Administration of State Facilities","Part 63A-5b-12 Public School Construction Oversight"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter5b/63A-5b-S1214.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"10818b26543adb7a1143487cb9f8f50a30973c7d5b9e23a4794514fc4ed20daf","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-5b-1213","next":"us-ut/utah-code-63a-5b-1215"},"notice":"GroundRules: Original legal text.
