{"data":{"id":"us-ut/utah-code-63a-5b-1215","jurisdiction":"us-ut","citation":"Utah Code § 63A-5b-1215","heading":"Enforcement and penalties.","body":"(1) If an LEA fails to comply with requirements established under this part, the division may:\n(a) issue written warnings and compliance orders;\n(b) suspend or revoke construction permits;\n(c) require additional inspections at the LEA's expense;\n(d) impose administrative penalties as provided in rule; and\n(e) refer matters to appropriate authorities for further action.\n(2) The division may not assess administrative penalties that exceed:\n(a) $1,000 for minor violations;\n(b) $5,000 for significant violations; and\n(c) $25,000 for violations that pose safety risks or involve willful noncompliance.\n(3) Before imposing penalties, the division shall:\n(a) provide written notice of alleged violations;\n(b) allow reasonable time for correction;\n(c) provide opportunity for a hearing; and\n(d) consider the LEA's compliance history and efforts to remedy violations.\n(4) Penalty funds collected shall be deposited into the account established in Section 63A-5b-1219.\n(5) An LEA may appeal enforcement actions, penalties, or other division decisions under this section to the appeals panel established under Section 63A-5b-1221.\n(6) The division shall conduct mandatory compliance audits of:\n(a) 10% of all projects annually, selected randomly;\n(b) any project exceeding cost benchmarks by more than 20%;\n(c) any LEA with previous compliance violations; and\n(d) any project with reported safety concerns.\n(7) For serious violations involving life safety, the division may:\n(a) require immediate work stoppage until corrections are made;\n(b) mandate third-party oversight at an LEA's expense;\n(c) require remedial training for LEA officials; and\n(d) refer matters to the applicable professional licensing board.","path":["Title 63A Utah Government Operations Code","Chapter 63A-5b Administration of State Facilities","Part 63A-5b-12 Public School Construction Oversight"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter5b/63A-5b-S1215.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"dbc13deebc0276093c80c9ec1eb5b0fc8335dff9cd1bf6a6b051bab66af8d861","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-5b-1214","next":"us-ut/utah-code-63a-5b-1216"},"notice":"GroundRules: Original legal text.
