{"data":{"id":"us-ut/utah-code-63a-5b-1219","jurisdiction":"us-ut","citation":"Utah Code § 63A-5b-1219","heading":"Public School Construction Oversight Restricted Account.","body":"(1)\n(a) There is created within the General Fund a restricted account known as the \"Public School Construction Oversight Restricted Account.\"\n(b) The account shall be funded by:\n(i) construction oversight fees collected under Section 63A-5b-1214;\n(ii) administrative fees collected for division-managed construction services under Section 63A-5b-1213; and\n(iii) any penalties collected under Section 63A-5b-1215.\n(c) Money in the account:\n(i) shall be used exclusively for public school construction oversight activities described in this part;\n(ii) may not be used for other division operations unrelated to public school construction oversight;\n(iii) does not lapse at the end of a fiscal year; and\n(iv) shall earn interest, which shall be deposited into the account.\n(2) The Legislature may appropriate money from the account to the division for implementation of this part, including:\n(a) plan review and permitting activities;\n(b) inspection roster maintenance and oversight;\n(c) cost database development and maintenance;\n(d) training and technical assistance programs;\n(e) compliance monitoring and enforcement;\n(f) online document management system operation;\n(g) standardized design template development;\n(h) staffing costs directly related to public school construction oversight;\n(i) contracted services necessary for oversight activities; and\n(j) other oversight activities this part requires.\n(3) The division shall:\n(a) maintain separate accounting for revenue and expenditures from the account;\n(b) upon request, report to the Legislature on:\n(i) total fee revenue collected;\n(ii) account balance;\n(iii) expenditures by category; and\n(iv) projected future revenue and expenses; and\n(c) ensure that fee rates are sufficient to fund oversight activities without requiring additional appropriations.","path":["Title 63A Utah Government Operations Code","Chapter 63A-5b Administration of State Facilities","Part 63A-5b-12 Public School Construction Oversight"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter5b/63A-5b-S1219.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"0291295ed76f5d83c49a8b28ce1ffe06a36ebd80d987539f2008992610d56ab5","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-5b-1218","next":"us-ut/utah-code-63a-5b-1220"},"notice":"GroundRules: Original legal text.
