{"data":{"id":"us-ut/utah-code-63a-5b-401","jurisdiction":"us-ut","citation":"Utah Code § 63A-5b-401","heading":"Definitions.","body":"As used in this part:\n(1)\n(a) \"Capital development project\" means:\n(i) a remodeling or site or utility improvement project with a total cost of $3,500,000 or more;\n(ii) a new facility with a construction cost of $500,000 or more; or\n(iii) a purchase of real property if an appropriation is requested and made for the purchase.\n(b) \"Capital development project\" does not include a capital improvement project.\n(2) \"Capital improvement project\" means:\n(a) a remodeling, alteration, replacement, repair, or site or utility improvement project:\n(i) with a total cost of less than $3,500,000; or\n(ii)\n(A) with a total cost of $3,500,000 or more; and\n(B) that will be paid for with funds that are not state funds;\n(b) a utility infrastructure improvement project that:\n(i) has a total cost of less than $7,000,000;\n(ii) consists of two or more projects that, if done separately, would each cost less than $3,500,000; and\n(iii) the division determines is more cost effective or feasible to be completed as a single project; or\n(c) a new facility with a total construction cost of less than $500,000.\n(3)\n(a) \"New facility\" means a new building constructed on state property regardless of the source of the funding that pays for construction of the new building.\n(b) \"New facility\" includes:\n(i) an addition to an existing building; and\n(ii) the enclosure of space that was not previously fully enclosed.\n(c) \"New facility\" does not include:\n(i) the replacement of state-owned space that is demolished or that is otherwise removed from state use, if the total construction cost of the replacement space is less than $3,500,000; or\n(ii) the construction of facilities that do not fully enclose a space.\n(4) \"Replacement cost\" means, as determined by the Division of Risk Management:\n(a) for state facilities, excluding auxiliary facilities as defined by the director, the cost to replace those facilities; and\n(b) for infrastructure, as defined by the director, the cost to replace the infrastructure.\n(5) \"State funds\" means public money appropriated by the Legislature.","path":["Title 63A Utah Government Operations Code","Chapter 63A-5b Administration of State Facilities","Part 63A-5b-4 Development of Capital Facilities"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter5b/63A-5b-S401.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"089c4d06a4bcdc63dda9392252947114a2d10027a458bf52f788d8eb6c577d7d","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-5b-305","next":"us-ut/utah-code-63a-5b-402"},"notice":"GroundRules: Original legal text.
