{"data":{"id":"us-ut/utah-code-63a-5b-807","jurisdiction":"us-ut","citation":"Utah Code § 63A-5b-807","heading":"Eminent domain of unincorporated city owned land.","body":"(1) As used in this section:\n(a) \"County of the first class\" means a county that is classified by population as a county of the first class under Section 17-60-104.\n(b) \"Unincorporated land\" means land that before January 1, 2025, was not within the boundaries of a city.\n(2) The division may exercise eminent domain, consistent with the procedures described in Title 78B, Chapter 6, Part 5, Eminent Domain, to condemn unincorporated land for the public use of constructing a new facility on the land for homelessness services provided by, or under contract with, the state if the land is owned by a city that is the seat of government for a county of the first class.\n(3) The division may consult with the Department of Transportation for assistance in performing the division's duties under Subsection (2).","path":["Title 63A Utah Government Operations Code","Chapter 63A-5b Administration of State Facilities","Part 63A-5b-8 Acquisitions of Real Property Interests"],"source_url":"https://le.utah.gov/xcode/Title63A/Chapter5b/63A-5b-S807.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"490cd460d04c327657754a5f9e52b750aa0a566fbc570dfda1c406e2892352a3","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63a-5b-806","next":"us-ut/utah-code-63a-5b-901"},"notice":"GroundRules: Original legal text.
