{"data":{"id":"us-ut/utah-code-63d-3-105","jurisdiction":"us-ut","citation":"Utah Code § 63D-3-105","heading":"Remedies.","body":"(1) A person who brings a civil action against an individual for a violation of Section 63D-3-104 may:\n(a) recover actual damages, including the person's:\n(i) lost profits;\n(ii) economic damages; and\n(iii) reasonable cost of remediation efforts related to the violation;\n(b) recover consequential damages, including for interruption of service;\n(c) recover, from the individual, the individual's profit obtained through trafficking in anything obtained by the individual through the violation;\n(d) obtain injunctive or other equitable relief to prevent a future violation of Section 63D-3-104; and\n(e) recover anything the individual obtained through the violation, including:\n(i) misappropriated information or code;\n(ii) a misappropriated program; and\n(iii) any copies of the information, code, or program described in Subsections (1)(e)(i) and (1)(e)(ii).\n(2) A court shall award reasonable attorney fees to the prevailing party in any action arising under this part.\n(3) The remedies available for a violation of Section 63D-3-104 are in addition to remedies otherwise available for the same conduct under federal or state law.\n(4) A person may not file a civil action under Section 63D-3-104 later than three years after the day on which:\n(a) the violation occurred; or\n(b)\n(i) the person discovers the violation; or\n(ii) the person should have discovered the violation if the person acted with reasonable diligence to discover the violation.","path":["Title 63D Information Technology Act","Chapter 63D-3 Unauthorized Access to Information Technology","Part 63D-3-1 Computer Abuse and Data Recovery Act"],"source_url":"https://le.utah.gov/xcode/Title63D/Chapter3/63D-3-S105.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"de4ef2b3b22b3b967b0316f368bb6520330c74c2e77e96b9bf26f0ebaef409a3","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63d-3-104","next":"us-ut/utah-code-63d-3-106"},"notice":"GroundRules: Original legal text.
