{"data":{"id":"us-ut/utah-code-63g-16-301","jurisdiction":"us-ut","citation":"Utah Code § 63G-16-301","heading":"Definitions.","body":"As used in this part:\n(1) \"Applicable federal agency\" means the federal agency that issued a federal guidance letter.\n(2) \"Commission\" means the Federalism Commission created in Section 63C-4a-302.\n(3) \"Education entity\" means:\n(a) the State Board of Education;\n(b) the Utah Board of Higher Education;\n(c) the State Charter School Board created in Section 53G-5-201;\n(d) a local school board described in Title 53G, Chapter 4, School Districts; or\n(e) a charter school governing board described in Title 53G, Chapter 5, Charter Schools.\n(4) \"Federal agency\" means a department, agency, authority, commission, council, board, office, bureau, or other administrative unit of the executive branch of the United States government.\n(5)\n(a) \"Federal guidance letter\" means a written statement by a federal agency, regardless of format, that:\n(i) clarifies or provides instruction on:\n(A) the federal agency's interpretation of a federal law; or\n(B) the federal agency's policies for administering a federal law; and\n(ii) is nonbinding and of general applicability.\n(b) \"Federal guidance letter\" does not include:\n(i) a written communication between a federal agency and a state agency regarding a specific entity;\n(ii) a peer-to-peer communication; or\n(iii) a written communication between a federal agency and the State Tax Commission containing guidance related to the protection, storage, or safeguarding of confidential information.\n(6) \"Federal law\" means:\n(a) a statute passed by the United States Congress; or\n(b) a rule or regulation adopted by a federal agency.\n(7) \"State agency\" means:\n(a) a department, division, board, council, committee, institution, office, bureau, or other similar administrative unit of the executive branch of state government; or\n(b) an education entity.","path":["Title 63G General Government","Chapter 63G-16 State Sovereignty","Part 63G-16-3 Federal Guidance Letters"],"source_url":"https://le.utah.gov/xcode/Title63G/Chapter16/63G-16-S301.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"84c13d72c96cff5f626246628d26c8ed323c6ae684a10ec051854c24b953c542","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63g-16-202","next":"us-ut/utah-code-63g-16-302"},"notice":"GroundRules: Original legal text.
