{"data":{"id":"us-ut/utah-code-63g-6a-2404.3","jurisdiction":"us-ut","citation":"Utah Code § 63G-6a-2404.3","heading":"Dividing a procurement to avoid using a standard procurement process.","body":"(1) It is unlawful for a person knowingly to divide a single procurement into multiple smaller procurements if dividing the single procurement:\n(a) is done with the intent to avoid the use of a standard procurement process that would have otherwise been required if the procurement had not been divided;\n(b) constitutes unlawful conduct under Subsection 63G-6a-506(8); or\n(c) is otherwise prohibited by this chapter.\n(2) A violation of Subsection (1) is:\n(a) a second degree felony, if the value of the procurement before being divided is $1,000,000 or more;\n(b) a third degree felony, if the value of the procurement before being divided is $250,000 or more but less than $1,000,000;\n(c) a class A misdemeanor, if the value of the procurement before being divided is $100,000 or more but less than $250,000; or\n(d) a class B misdemeanor, if the value of the procurement before being divided is less than $100,000.","path":["Title 63G General Government","Chapter 63G-6a Utah Procurement Code","Part 63G-6a-24 Unlawful Conduct and Penalties"],"source_url":"https://le.utah.gov/xcode/Title63G/Chapter6a/63G-6a-S2404.3.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"ff4fddf41874d169a80a4adec3fa5b22cf30ec5149c8c24a8ab08d902c723188","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63g-6a-2404","next":"us-ut/utah-code-63g-6a-2404.7"},"notice":"GroundRules: Original legal text.
