{"data":{"id":"us-ut/utah-code-63g-6a-2505","jurisdiction":"us-ut","citation":"Utah Code § 63G-6a-2505","heading":"Debarment or suspension from consideration for award of contracts.","body":"(1) The executive director may:\n(a) debar or suspend a person from consideration for an award of a contract for a human services procurement item for any amount of time in accordance with the process described in Subsection 63G-6a-904(1); and\n(b) obtain the recommendation of the council before debarring or suspending the person.\n(2) The council shall recommend that the executive director debar or suspend a person for an award of a contract for a human services procurement item if the person:\n(a) is convicted of a criminal offense:\n(i) for actions taken to obtain or perform under a public or private contract;\n(ii) for embezzlement, fraud, theft, forgery, bribery, falsification or destruction of records, or receiving stolen property; or\n(iii) under Title 76, Chapter 16, Part 5, Antitrust Offenses, or another antitrust law;\n(b) fails, without good cause, to perform in accordance with the terms of a contract with the department;\n(c) commits two or more violations of department rules made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act;\n(d) violates this chapter;\n(e) poses a significant risk of harm to department clients or the department;\n(f) is barred or suspended from providing services to another governmental agency; or\n(g) takes another action that the council determines is fraudulent or substantially affects the person's ability to perform under a contract with the department for a human services procurement item.","path":["Title 63G General Government","Chapter 63G-6a Utah Procurement Code","Part 63G-6a-25 Human Services Procurements"],"source_url":"https://le.utah.gov/xcode/Title63G/Chapter6a/63G-6a-S2505.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"cdd626a0c896e5389020c2967243eaf41b5b9f308038c06dadc014890992c146","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63g-6a-2504","next":"us-ut/utah-code-63g-6a-2506"},"notice":"GroundRules: Original legal text.
