{"data":{"id":"us-ut/utah-code-63g-6a-409","jurisdiction":"us-ut","citation":"Utah Code § 63G-6a-409","heading":"Request for information.","body":"(1) A procurement unit may issue a request for information to obtain information, comments, or suggestions before issuing a solicitation.\n(2)\n(a) A request for information is not a procurement process and may not be used to:\n(i) negotiate fees;\n(ii) make a purchase;\n(iii) determine whether a procurement may be made under Part 8, Exceptions to Procurement Requirements; or\n(iv) enter into a contract.\n(b) To make a purchase or enter into a contract, a procurement unit is required to:\n(i) use a standard procurement process; or\n(ii) comply with an exception to the requirement to use a standard procurement process, as described in Part 8, Exceptions to Procurement Requirements.\n(3) A response to a request for information is not an offer and may not be accepted to form a binding contract.\n(4) A procurement unit that receives pricing information in response to a request for information shall ensure that an individual who serves on an evaluation committee to evaluate proposals that include a proposal as to which the pricing information applies does not have access to the pricing information, except as provided in Subsection 63G-6a-707(7).\n(5) A record containing information submitted to or by a governmental entity in response to a request for information is a protected record under Section 63G-2-305.","path":["Title 63G General Government","Chapter 63G-6a Utah Procurement Code","Part 63G-6a-4 Supplemental Procurement Procedures"],"source_url":"https://le.utah.gov/xcode/Title63G/Chapter6a/63G-6a-S409.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"1e5217a5f181c249102d4033e707b4d4e8b4a5caf510f5444853206a9f1279f6","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63g-6a-401","next":"us-ut/utah-code-63g-6a-410"},"notice":"GroundRules: Original legal text.
