{"data":{"id":"us-ut/utah-code-63g-6b-101","jurisdiction":"us-ut","citation":"Utah Code § 63G-6b-101","heading":"Definitions.","body":"As use in this chapter:\n(1)\n(a) \"Administering agency\" means a state agency that administers a grant.\n(b) \"Administering agency\" includes a state agency that wholly or partially administers a grant on another state agency's behalf.\n(2) \"Competitive grant\" means a grant that is not a direct award grant.\n(3) \"Direct award grant\" means a grant that is funded by money that the Legislature intends the state agency to pass through to one or more recipients without a competitive process.\n(4)\n(a) \"Grant\" means a state agency's expenditure of state money, or agreement to expend state money, that is:\n(i) authorized by law;\n(ii) made for a particular purpose; and\n(iii) made without acquiring, or the promise of acquiring, a procurement item in exchange for the expenditure.\n(b) \"Grant\" does not include:\n(i) a tax credit;\n(ii) an expenditure of federal money;\n(iii) public assistance, as defined in Section 26B-9-101;\n(iv) a loan;\n(v) a rebate;\n(vi) an incentive; or\n(vii) a claim payment.\n(5) \"Grant agreement\" means the agreement between an administering agency and a grant recipient described in Subsection 63G-6b-201(4).\n(6) \"Grant appropriation\" means an appropriation the Legislature makes to an administering agency to be used for one or more grants.\n(7) \"Grant period\" means the time frame during which a grant recipient receives funds from a single grant.\n(8) \"Multi-year grant\" means a grant for which the grant period exceeds one year.\n(9) \"Nonprofit entity\" means an entity that:\n(a) operates in the state;\n(b) is not a government entity; and\n(c) is exempt from federal income taxation under Section 501(c)(3) or (19), Internal Revenue Code.\n(10) \"Procurement item\" means the same as that term is defined in Section 63G-6a-103.\n(11)\n(a) \"State agency\" means a department, division, or other agency or instrumentality of the state.\n(b) \"State agency\" does not include the legislative department.\n(12) \"State money\" means money that is derived from state fees or state tax revenue.","path":["Title 63G General Government","Chapter 63G-6b State Grants","Part 63G-6b-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title63G/Chapter6b/63G-6b-S101.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"56189c86b503fbb2723589df2dc4636fe00cea49660d720d411540dae389ad1b","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63g-6a-2507","next":"us-ut/utah-code-63g-6b-102"},"notice":"GroundRules: Original legal text.
