{"data":{"id":"us-ut/utah-code-63g-7-903","jurisdiction":"us-ut","citation":"Utah Code § 63G-7-903","heading":"Recovery of judgment paid and defense costs by government employee.","body":"(1) Subject to Subsection (2), if an employee pays a judgment entered against him, or any portion of it, that the governmental entity is required to pay under Section 63G-7-902, the employee may recover from the governmental entity the amount of the payment and the reasonable costs incurred in the employee's defense.\n(2)\n(a) If a governmental entity does not conduct the defense of an employee against a claim, or conducts the defense under a reservation of rights as provided in Subsection 63G-7-902(6), the employee may recover from the governmental entity under Subsection (1) if the employee can prove that none of the conditions set forth in Subsection 63G-7-202(3)(c) applied.\n(b) The employee has the burden of proof that none of the conditions set forth in Subsection 63G-7-202(3)(c) applied.","path":["Title 63G General Government","Chapter 63G-7 Governmental Immunity Act of Utah","Part 63G-7-9 Coverage and Representation of State Entities and Employees"],"source_url":"https://le.utah.gov/xcode/Title63G/Chapter7/63G-7-S903.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"667ed2c35eaf9663963e6622807f442718dbd1efb376d63b64cc9c9d1e4a46dd","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63g-7-902","next":"us-ut/utah-code-63g-7-904"},"notice":"GroundRules: Original legal text.
