{"data":{"id":"us-ut/utah-code-63n-13-302","jurisdiction":"us-ut","citation":"Utah Code § 63N-13-302","heading":"Definitions.","body":"As used in this part:\n(1) \"Bonding government entity\" means the same as that term is defined in Section 63C-25-101.\n(2) \"Concessionaire contract\" means the same as that term is defined in Section 63C-25-101.\n(3) \"Facilitator\" means:\n(a) the office, if the office chooses to perform itself the functions and responsibilities described in Section 63N-13-304; or\n(b) a person engaged by the office to perform the functions and responsibilities described in Section 63N-13-304, if the office chooses to have those functions and responsibilities performed by a person other than the office.\n(4) \"Government entity\" means:\n(a) the state or any department, division, agency, or other instrumentality of the state; or\n(b) a political subdivision of the state.\n(5) \"Public-private partnership\" means an arrangement or agreement between a government entity and one or more private persons to fund and provide for a public need through the development or operation of a public project in which the private person or persons share with the government entity the responsibility or risk of developing, owning, maintaining, financing, or operating the project.","path":["Title 63N Economic Opportunity Act","Chapter 63N-13 Procurement Programs","Part 63N-13-3 Facilitating Public-private Partnerships Act"],"source_url":"https://le.utah.gov/xcode/Title63N/Chapter13/63N-13-S302.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"a74b6252ba7ea50c836109584b6ba5d40fd0c83700f2cb963c48e31a81c67a7c","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63n-13-301","next":"us-ut/utah-code-63n-13-303"},"notice":"GroundRules: Original legal text.
