{"data":{"id":"us-ut/utah-code-63n-2-104","jurisdiction":"us-ut","citation":"Utah Code § 63N-2-104","heading":"Creation of economic development zones -- Tax credits -- Assignment of tax credit.","body":"(1) The office may create an economic development zone in the state if the following requirements are satisfied:\n(a) the area is located within a commercial or industrial zone;\n(b) the local government entity having jurisdiction over the area supports the creation of the development zone; and\n(c) the local government entity described in Subsection (1)(b) provides or commits to provide local incentives within the area in accordance with the local government entity's approved incentive policy.\n(2) A local government entity may, for the purpose of incentivizing new commercial projects within the local government entity's boundaries, create an economic development zone if the following requirements are satisfied:\n(a) the area is located:\n(i) within a commercial or industrial zone; and\n(ii) within the geographic boundaries of the local government entity;\n(b) the local government entity adopts a long-term plan that addresses the following planning elements within the area:\n(i) transportation and infrastructure;\n(ii) workforce development; and\n(iii) housing needs; and\n(c) the office approves the local government entity's request to create the development zone.","path":["Title 63N Economic Opportunity Act","Chapter 63N-2 Tax Credit Incentives for Economic Development","Part 63N-2-1 Economic Development Tax Increment Financing"],"source_url":"https://le.utah.gov/xcode/Title63N/Chapter2/63N-2-S104.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"37bb2d608c15c458117943cb0bb59f9f9bc078f51d839e7f3b3721703520b38f","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63n-2-103","next":"us-ut/utah-code-63n-2-104.1"},"notice":"GroundRules: Original legal text.
