{"data":{"id":"us-ut/utah-code-63n-3-1801","jurisdiction":"us-ut","citation":"Utah Code § 63N-3-1801","heading":"Definitions.","body":"As used in this part:\n(1) \"Board\" means the State Housing Infrastructure Partnership Board created in Section 63N-3-1803.\n(2) \"Development agreement\" means the same as that term is defined in Section 10-20-102.\n(3) \"Fund\" means the State Housing Infrastructure Partnership Fund created in Section 63N-3-1802.\n(4) \"Housing development\" means a land development proposal to construct new housing that a municipality or a county approves with a land use application, development agreement, or zone change.\n(5) \"Infrastructure facility\" means a facility used in connection with system-level infrastructure, including:\n(a) a drinking water facility;\n(b) a wastewater facility;\n(c) a sewer lift station;\n(d) a stormwater system;\n(e) a water drainage system;\n(f) a secondary water system;\n(g) power transmission and distribution lines, including burying of the lines; or\n(h) a regional transportation facility.\n(6) \"Infrastructure loan\" means a loan of fund money to finance a system improvement.\n(7) \"Land use application\" means the same as that term is defined in Section 10-20-102.\n(8) \"Qualifying political subdivision\" means:\n(a) a municipality;\n(b) a county;\n(c) a special district;\n(d) a special service district;\n(e) an agency as defined in Section 17C-1-102; or\n(f) the Point of the Mountain State Land Authority created in Section 11-59-201.\n(9) \"Special district\" means the same as that term is defined in Section 17B-1-102.\n(10) \"Special service district\" means the same as that term is defined in Section 17D-1-102.\n(11)\n(a) \"System improvement\" means a project to construct or improve a publicly owned:\n(i) highway, public transit facility, or paved pedestrian or non-motorized trail that is a part of:\n(A) the statewide long-range transportation plan;\n(B) a regional transportation plan of a metropolitan planning organization; or\n(C) a municipal or county general plan, transportation master plan, or economic development initiative; or\n(ii) infrastructure facility that is part of:\n(A) a municipal or county general plan, infrastructure plan, or economic development initiative; or\n(B) a special district infrastructure plan or strategic plan.\n(b) \"System improvement\" may include the costs of:\n(i) designing a project described in Subsection (11)(a);\n(ii) acquiring property for a project described in Subsection (11)(a); or\n(iii) environmental remediation for a project described in Subsection (11)(a).","path":["Title 63N Economic Opportunity Act","Chapter 63N-3 Economic Development Programs","Part 63N-3-18 State Housing Infrastructure Partnership"],"source_url":"https://le.utah.gov/xcode/Title63N/Chapter3/63N-3-S1801.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"8e5d4202f94103c4696b16d6878b784eba9d945a9cc61d4258961e2c178b4539","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63n-3-1712","next":"us-ut/utah-code-63n-3-1802"},"notice":"GroundRules: Original legal text.
