{"data":{"id":"us-ut/utah-code-63n-3a-402","jurisdiction":"us-ut","citation":"Utah Code § 63N-3a-402","heading":"Incentives prohibited -- Exception.","body":"(1)\n(a) Except as provided in Subsection (1)(b), a county or municipality may not offer an incentive for a large load data center that is not located within a zone.\n(b) Subsection (1)(a) does not apply to:\n(i) a project area established before May 6, 2027; or\n(ii) an agreement between a county or municipality and a private entity that was executed before May 6, 2027.\n(2) In addition to the requirements described in Part 2, Creation of Regionally Significant Development Zones, a creating entity that proposes a zone shall include in the proposal:\n(a) a description of the proposed boundaries of the zone;\n(b) an assessment of existing electrical energy infrastructure within and proximate to the proposed zone;\n(c) a development plan that includes:\n(i) anticipated infrastructure improvements;\n(ii) projected economic benefits to the county or municipality; and\n(iii) evidence of local support, as applicable; and\n(d) any other information required by the committee.\n(3) A proposal for a zone described in this part:\n(a) shall include the diversion of all personal property tax revenue generated within the zone, as described in Subsection 63N-3a-203(4)(c)(ii); and\n(b) may include a request to:\n(i) capture up to 60% of the property tax increment generated within the zone; and\n(ii) divert up to 100% of personal property tax revenue generated within the zone.\n(4) A proposed zone may not overlap with:\n(a) a project area designated by a community reinvestment agency; or\n(b) a project area created by the Utah Inland Port Authority or the Military Installation Development Authority.","path":["Title 63N Economic Opportunity Act","Chapter 63N-3a Coordination Of Regional Economic Development Activity","Part 63N-3a-4 Regionally Significant Zones With Energy Implications"],"source_url":"https://le.utah.gov/xcode/Title63N/Chapter3a/63N-3a-S402.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"0ac6a56af6aa091488448ac11857a3a9fc796d997fd643023f283b78aa760eb0","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-63n-3a-401","next":"us-ut/utah-code-63n-3a-403"},"notice":"GroundRules: Original legal text.
