{"data":{"id":"us-ut/utah-code-65a-14-102","jurisdiction":"us-ut","citation":"Utah Code § 65A-14-102","heading":"Definitions.","body":"As used in this chapter:\n(1)\n(a) \"Bioprospecting\" means the removal from a natural environment for research or commercial use of:\n(i) a naturally occurring microorganism, plant, or fungus; or\n(ii) information concerning a naturally occurring microorganism's, plant's, or fungus' physical or genetic properties.\n(b) \"Bioprospecting\" does not include:\n(i) horticultural cultivation, except for horticultural genetic engineering conducted in a manner otherwise constituting bioprospecting;\n(ii) an agricultural enterprise;\n(iii) a forest and range management practice;\n(iv) invasive weed management;\n(v) Christmas tree and related sales; or\n(vi) incidental removal of a microorganism, plant, or fungus while engaged in bona fide research or commercial enterprises.\n(2) \"Nonfederal public land\" means land in the state that:\n(a) is not owned, controlled, or held in trust by the federal government; and\n(b)\n(i) is owned or controlled by:\n(A) the state;\n(B) a county, city, or town; or\n(C) a governmental entity other than the federal government; or\n(ii) is school and institutional trust lands, as defined in Section 53C-1-103.","path":["Title 65A Forestry, Fire, and State Lands","Chapter 65A-14 Utah Bioprospecting Act","Part 65A-14-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title65A/Chapter14/65A-14-S102.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"e6ba958a72055da99ecac32c3d72719545fe3e219d85aad0245204cbfbd5e0dc","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-65a-12-3","next":"us-ut/utah-code-65a-14-103"},"notice":"GroundRules: Original legal text.
