{"data":{"id":"us-ut/utah-code-65a-8-304","jurisdiction":"us-ut","citation":"Utah Code § 65A-8-304","heading":"Guidelines and standards for granting or denying applications to alter or remove trees.","body":"The division shall consider the following criteria in granting or denying an application:\n(1) the physical condition of the heritage tree or trees with respect to:\n(a) insect infestation;\n(b) disease;\n(c) danger of falling;\n(d) proximity to existing or proposed structures; and\n(e) interference with utility services;\n(2) the necessity of alteration or removal of the heritage tree or trees in order to construct proposed improvements and allow economic enjoyment of property;\n(3) the topography of the land and the effect of removal of the heritage tree or trees on:\n(a) erosion;\n(b) soil retention; and\n(c) the diversion or increased flow of surface waters resultant upon alteration or removal;\n(4) the number of heritage trees existing in the neighborhood on improved property;\n(5) the effect alteration or removal would have on established standards and property values in the area; and\n(6) the number of heritage trees the particular parcel can support according to good forestry practices.","path":["Title 65A Forestry, Fire, and State Lands","Chapter 65A-8 Management of Forest Lands and Fire Control","Part 65A-8-3 Heritage Trees"],"source_url":"https://le.utah.gov/xcode/Title65A/Chapter8/65A-8-S304.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"f8d96f921d91ca22f52cac3de61b18cf9f5f8b40dc4fcc1b8218f11c0622652f","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-65a-8-303","next":"us-ut/utah-code-65a-8-305"},"notice":"GroundRules: Original legal text.
