{"data":{"id":"us-ut/utah-code-67-16-12","jurisdiction":"us-ut","citation":"Utah Code § 67-16-12","heading":"Penalties for violation -- Removal from office or dismissal from employment.","body":"In addition to any penalty contained in any other provision of law:\n(1) any public officer or public employee who knowingly and intentionally violates this chapter, with the exception of Sections 67-16-6 and 67-16-7, shall be dismissed from employment or removed from office as provided by law, rule, or policy within the agency; and\n(2) any public officer, public employee, or person who knowingly and intentionally violates this chapter, with the exception of Sections 67-16-6 and 67-16-7, shall be punished as follows:\n(a) as a felony of the second degree if the total value of the compensation, conflict of interest, or assistance exceeds $1,000;\n(b) as a felony of the third degree if:\n(i) the total value of the compensation, conflict of interest, or assistance is more than $250 but not more than $1,000; or\n(ii) the public officer or public employee has been twice before convicted of violation of this chapter and the value of the conflict of interest, compensation, or assistance was $250 or less;\n(c) as a class A misdemeanor if the value of the compensation or assistance was more than $100 but does not exceed $250; or\n(d) as a class B misdemeanor if the value of the compensation or assistance was $100 or less.","path":["Title 67 State Officers and Employees","Chapter 67-16 Utah Public Officers' and Employees' Ethics Act"],"source_url":"https://le.utah.gov/xcode/Title67/Chapter16/67-16-S12.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"8bed707717854d5d0d2ce7a6d66e4017c2477260b6faa7134a49364150701e8e","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-67-16-11","next":"us-ut/utah-code-67-16-14"},"notice":"GroundRules: Original legal text.
