{"data":{"id":"us-ut/utah-code-67-19d-302","jurisdiction":"us-ut","citation":"Utah Code § 67-19d-302","heading":"State treasurer to follow \"prudent investor\" rule -- Standard of care.","body":"(1) The state treasurer shall invest and manage the trust fund assets as a prudent investor would, by:\n(a) considering the purposes, terms, distribution requirements, and other circumstances of the trust fund; and\n(b) exercising reasonable care, skill, and caution in order to meet the standard of care of a prudent investor.\n(2) In determining whether or not the state treasurer has met the standard of care of a prudent investor, the judge or finder of fact shall:\n(a) consider the state treasurer's actions in light of the facts and circumstances existing at the time of the investment decision or action, and not by hindsight; and\n(b) evaluate the state treasurer's investment and management decisions respecting individual assets:\n(i) not in isolation, but in the context of a trust fund portfolio as a whole; and\n(ii) as a part of an overall investment strategy that has risk and return objectives reasonably suited to the trust fund.","path":["Title 67 State Officers and Employees","Chapter 67-19d State Post-Retirement Benefits Trust Fund Act","Part 67-19d-3 Trust Fund Investments"],"source_url":"https://le.utah.gov/xcode/Title67/Chapter19d/67-19d-S302.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"7421c22dd60c36957932077423a15e5ba7e85ecfe15b301ad0d5ad0e03670ad1","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-67-19d-301","next":"us-ut/utah-code-67-19f-102"},"notice":"GroundRules: Original legal text.
