{"data":{"id":"us-ut/utah-code-67-19f-302","jurisdiction":"us-ut","citation":"Utah Code § 67-19f-302","heading":"State treasurer to follow \"prudent investor\" rule -- Standard of care.","body":"(1) The state treasurer shall invest and manage the trust fund assets as a prudent investor would, by:\n(a) considering the purposes, terms, distribution requirements, and other circumstances of the trust fund; and\n(b) exercising reasonable care, skill, and caution in order to meet the standard of care of a prudent investor.\n(2) In determining whether the state treasurer has met the standard of care of a prudent investor, the judge or finder of fact shall:\n(a) consider the state treasurer's actions in light of the facts and circumstances existing at the time of the investment decision or action, and not by hindsight; and\n(b) evaluate the state treasurer's investment and management decisions respecting individual assets:\n(i) not in isolation, but in the context of the trust fund portfolio as a whole; and\n(ii) as a part of an overall investment strategy that has risk and return objectives reasonably suited to the trust fund.","path":["Title 67 State Officers and Employees","Chapter 67-19f State Employees' Annual Leave Trust Fund Act","Part 67-19f-3 Investment of Trust Funds"],"source_url":"https://le.utah.gov/xcode/Title67/Chapter19f/67-19f-S302.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"615d573ef68e563959704c9ccb8c00800de5528a2393ef7caf7786f13390fc46","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-67-19f-301","next":"us-ut/utah-code-67-20-1"},"notice":"GroundRules: Original legal text.
